A Mumbai court has granted bail to an autorickshaw driver accused of making sexually explicit remarks to a 24-year-old woman passenger, observing that there was no allegation of physical contact and that his continued detention before trial was not warranted. Read Full Story According to the FIR, the woman alleged that during an autorickshaw ride in Mumbai's Andheri on June 4, the driver made sexually explicit comments, including remarks expressing a desire for sex and saying he became "crazy" on seeing women like her.
She also alleged that he threatened her with consequences if she disclosed the incident. "Suno ek baat batau. Aap meri bahan jaisi ho... Sex karne ka jyada shauk hai mujhe. Aap jaisi ladki ko jab dekhta hoon, toh pagal hojaata hoon aapko dekhke. Abhi haath lagaake dekho" ("Listen, let me tell you something. You are like a sister to me, but I have a strong desire for sex. When I see women like you, I go crazy. Looking at you makes me feel that way. Let me touch you right now"), the woman alleged in the FIR, quoting the driver.
The complainant said the incident occurred while she was travelling from Oshiwara's Fun Republic area to Juhu Versova Link Road between 6:42 am and 7:05 am. Following her complaint, police registered a case and arrested Bairgi on June 6. After an initial period of police custody, he was remanded to judicial custody. Granting bail, the court noted that the investigation did not require any further recovery or seizure from the accused. It also observed that the offences invoked carry a maximum punishment ranging from two to three years. The judge said the concerns raised by the complainant and the prosecution could be addressed through stringent bail conditions.
The court directed Bairgi's release on a personal bond of Rs 25,000 with one surety of the same amount. As part of the conditions, he has been barred from contacting, stalking or approaching the complainant, entering her residential or educational premises, tampering with evidence, influencing witnesses, or engaging in similar conduct. He has also been directed to regularly mark his attendance at the DN Nagar police station. Ends
