The report said no US governor had previously imposed a statewide data centre moratorium. Communities across the US have raised concerns about the impact of data centres on local infrastructure. Critics say the facilities consume large amounts of electricity and water, create noise, and add pressure on power grids while generating relatively few jobs.
As a result, state leaders are facing increasing pressure from voters to tighten oversight of new projects. Axios reported that moratorium proposals are now emerging in several states. Even in Republican-led Texas, Governor Greg Abbott has called for restrictions on new AI data centres in rural neighbourhoods and has said companies should bear more of the cost of the infrastructure they require. The report further said Hochul’s approach balances quick action with continued negotiations on long-term regulation, a strategy that could be adopted by other governors. The issue has also gained national attention after Senator Bernie Sanders and Representative Alexandria Ocasio-Cortez earlier proposed a nationwide pause on new data centre projects until wider AI safety measures are introduced. New York Pauses New Large Data Centre Projects New York became the first US state to halt permits for new large-scale data centres after Hochul signed an executive order introducing a moratorium of up to one year. The pause applies to projects with a capacity of 50 megawatts or more and takes effect immediately. The state said the break will allow officials to develop stronger rules for the fast-growing sector, driven by rising demand for artificial intelligence.
Hochul also announced plans to pursue legislation to remove sales tax exemptions for large data centres. The New York legislature had earlier passed a stricter moratorium bill covering projects above 20 megawatts. However, Hochul chose to issue an executive order instead, saying more discussions were needed before broader legislation could be finalised.
