The accused have been identified as 24-year-old Prabal Pratap Singh, a third-year LLB student from Etawah in Uttar Pradesh, and 23-year-old Chander Bhan, a second-year law student from Rae Bareli. Both are the law students of Lucknow University. According to a statement released by the police, a case has been registered at Tilak Marg police station on a statement made by the security staff of the Supreme Court regarding the incident in which Prabal Pratap Singh hurled abuses at the Chief Justice and threw documents in the courtroom during the hearing.
“When security personnel intervened to maintain decorum and restrain him, he used criminal force against the complainant, obstructing him from performing his official duties," a senior police officer said. Following the complaint of the security personnel, an FIR was registered at Tilak Marg police station under various sections of the Bharatiya Nyaya Sanhita (BNS). What Happened On July 10? The incident took place on July 10 inside Court No 13 during the hearing of a Special Leave Petition filed by Prabal Pratap Singh, who was appearing as a petitioner-in-person before a bench of Justice KV Viswanathan and Justice Alok Aradhe. Prabal allegedly disrupted the proceedings by using abusive and objectionable language against the judges, throwing papers inside the courtroom and creating a commotion. The courtroom atmosphere turned dramatic when the petitioner, who appeared in person, displayed an unusually aggressive stance in his submissions. “Mr judicial servant. I order you to order the registration of an FIR against the ACP … Lucknow," he said as quoted by Bar and Bench. Justice Viswanathan immediately questioned the litigant’s remarks, asking, “You are ordering me?
You are ordering us?" The petitioner replied that everything was already on record. “That is all from my side. Everything is on record," he said. Moments later, he allegedly threw papers into the air and used abusive language against the Chief Justice of India, prompting security personnel to intervene and escort him out of the courtroom. When security personnel intervened to restore order, he allegedly pushed a security officer and obstructed him from performing official duties. During the investigation, both accused were taken to the Institute of Human Behaviour and Allied Sciences (IHBAS) for medical evaluation after observations made by the Supreme Court. Doctors declared both to be mentally sound and said they did not require immediate psychiatric intervention, police said. Investigators also recovered pamphlets containing objectionable language from the possession of the two accused. Police are now probing whether the courtroom disruption was pre-planned or part of a larger conspiracy. Despite the incident, the Supreme Court decided not to initiate contempt proceedings against the accused. Reacting to the incident earlier this week, Chief Justice of India Surya Kant urged people to “ignore" the episode, saying, “Youngsters sometimes do such things." He, however, stressed that maintaining the dignity and prestige of constitutional institutions remained the responsibility of everyone.
