The temporary ban will remain in place while state agencies prepare new environmental standards for future projects.
During this period, the Department of Environmental Conservation will not issue discretionary permits for eligible projects unless applications have already been deemed complete. State To Draft New Environmental Standards Hochul said the pause is intended to ensure that future data centre developments are assessed under clear and consistent rules. She has directed state officials to prepare a Generic Environmental Impact Statement examining the long-term effects of large facilities on energy use, water consumption, emissions and surrounding communities. The governor also said she would seek to remove sales tax exemptions currently available to large data centres, arguing that unchecked expansion could increase electricity bills, put pressure on natural resources and create uncertainty for residents. Officials said the moratorium will be lifted once the new environmental standards have been finalised. Growing Debate Over AI Infrastructure New York’s decision places the state at the centre of a wider national discussion over how to balance AI-driven investment with environmental protection. Legislatures in several states are considering measures to regulate data centres, although New York is the first to introduce a statewide moratorium.
A separate bill passed by the state legislature last month proposes restrictions on facilities using more than 20 megawatts of power, but it is yet to be signed into law. According to the New York Independent System Operator, more than 12 gigawatts of large electricity-demand projects, including data centres, were waiting to connect to the state’s power grid as of May.
