State BJP Executive member Mahesh Reddy Mudnal has objected to the State government’s notification introducing the Permanent Residence Certificate (PRC) and said that Union Home Minister Amit Shah should interfere and examine the State’s move. Addressing a press conference in Yadgir on Saturday, Mr. Mudnal said that the notification by the State government raises serious constitutional, legal and national security concerns.
Referring to a letter by Union Minister of State for Micro, Small and Medium Enterprises and Labour and Employment Shobha Karandlaje to Mr. Shah on July 8, Mr. Mudnal said that the notification is alarming from the perspective of national security and is violative of Article 14 of the Constitution. By creating a class of individuals designated as “permanent residents”, the State government is effectively conferring a distinct legal recognition that has no sanction under the Constitution, he said.
He further said that the eligibility criteria are based on residence and local verification by revenue authorities. However, there is no provision mandating verification of Indian citizenship through the competent Central authorities or any robust mechanism to exclude illegal immigrants and foreign nationals, he said. Consequently, those who have illegally entered India or are residing unlawfully in the State may secure a PRC by producing local documents through fraudulent means.
Therefore, the Union Home Ministry should examine the constitutional validity of the PRC through the competent agencies, he added.
