TCS Conversion Accused Nida Khan A Maharashtra court has granted bail to a former Tata Consultancy Services (TCS) employee accused in sexual harassment and alleged religious conversion cases, observing that the trauma of giving birth in prison, as Lord Krishna did, would be unbearable for any woman. Nida Khan, who is five months pregnant, was granted bail by a Nashik court on July 6. The detailed order became available on Thursday. “The trauma of giving birth in a prison like Lord Krishna or the related social stigma is not bearable for anyone," Additional Sessions Judge K G Joshi of the Nashik Road court said. The court said it was appropriate to exercise judicial discretion in Khan’s favour to prevent such an agonising situation and ensure the overall welfare and proper welcome of the newborn baby.
The judge also noted that keeping Khan in custody would serve no purpose as the investigation had been completed and a chargesheet had already been filed. Nida Khan Arrested After Being On The Run For Nearly 25 Days Khan was arrested on May 7 from a rented flat in Chhatrapati Sambhajinagar in central Maharashtra after allegedly remaining on the run for nearly 25 days. Her lawyer, Rahul Kasliwal, sought bail primarily on the ground of her pregnancy. He also argued that Khan was innocent and had been falsely implicated in the case. The defence told the court that Khan was highly educated and had previously worked as an associate at TCS before her employment was terminated in April. The court granted her bail on a personal bond of Rs 75,000, along with one solvent surety of the same amount. Prosecution Opposed Bail, Cited Evidence Of Sexual Assault And Religious Coercion Public prosecutor Vijay Gaikwad, along with lawyers Milind Kurkute and Nitin Pandit, who appeared for one of the victims, opposed the bail applications of Khan and co-accused Danish Shaikh.
They argued that the investigation had uncovered sufficient evidence of alleged sexual assault and religious coercion. Police are investigating a total of nine cases linked to allegations of exploitation, attempted forced religious conversion, hurting religious sentiments, molestation and mental harassment of women employees at the TCS unit in Nashik. What Are The Allegations Against Nida Khan? The case was registered by the Deolali Camp police under several provisions of the Bharatiya Nyaya Sanhita, including Section 69, related to sexual intercourse through deceitful means, Section 65 concerning sexual harassment, and Section 299 for outraging religious feelings. The accused have also been booked under relevant provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act as the victim belongs to the Dalit community. According to investigators, Khan allegedly attempted to influence the victim’s religious beliefs by giving her a burqa and religious literature. She is also accused of installing Islam-related applications on the woman’s mobile phone, visiting her home to teach her how to offer namaz and showing her how to wear a hijab. The allegations remain subject to judicial determination.
