Supreme Court Upholds Birthright Citizenship The Supreme Court rejected Trump’s bid to restrict birthright citizenship, dealing a setback to one of his signature immigration policies. In a 6-3 ruling, the court maintained the constitutional right to American citizenship for nearly everyone born on US soil. Trump had signed an executive order on the first day of his second term in the White House, directing that children born in the United States to parents who were in the country illegally or on temporary visas would no longer automatically receive US citizenship. Chief Justice John Roberts, writing for the majority, said, “Children born in the United States to parents unlawfully or temporarily present are ‘subject to the jurisdiction’ of the United States and are citizens at birth under the Fourteenth Amendment’s Citizenship Clause." “Citizenship, then and now, was the right to have rights, to freely participate in our political community. The Framers of the Fourteenth Amendment extended that promise to ‘every free-born person in this land.’ We keep that promise today," Roberts wrote.
