In an episode of Face Off, anchor Rajdeep Sardesai moderates a discussion on whether India's anti-defection laws and the Tenth Schedule need a complete overhaul. Senior Advocate Dushyant Dave states that the current system allows politicians to switch sides without consequence, driven by money power and a lack of moral character. He suggests a mandatory rule requiring any elected representative who wishes to change parties to first resign and recontest their seat, while also calling for an end to the reliance on floor tests.
Conversely, Senior Advocate Hitesh Jain states that the anti-defection law should not penalise collective political realignment. He points out the lack of internal democracy and the prevalence of hereditary leadership within political parties, stating that legislators must have the right to dissent and realign if a party abandons its original ideology. Both guests agree that political parties in India currently lack meaningful internal democracy, though they differ on how the law should address the defection of elected representatives.
