(File photo) The Centre on Friday informed the Supreme Court that it has decided to bring back some individuals who were allegedly deported to Bangladesh and subsequently verify their claims of Indian citizenship. Appearing for the Centre, Solicitor General Tushar Mehta told a bench led by Chief Justice Surya Kant that the decision was being taken due to the peculiar facts and circumstances of the case and should not be treated as a precedent.
Next Hearing In July “The government would bring them back and thereafter examine their status. Depending upon the outcome, we will take steps accordingly," Mehta submitted before the bench, also comprising Justices Joymalya Bagchi and Vipul M Pancholi. He added that the process may take eight to ten days, PTI reported. Calcutta HC Had Called Deportation ‘Illegal’ The matter has now been posted for hearing in July. The apex court was hearing the Centre’s appeal against a September 2025 order of the Calcutta High Court, which had termed the deportation of Sunali Khatun and others as “illegal". Last December, the top court had permitted Khatun and her eight-year-old child to re-enter India on “humanitarian grounds" after they were allegedly pushed into Bangladesh.
The court had also directed the West Bengal government to provide medical assistance and care to Khatun, who was pregnant at the time, the report mentioned. According to the petitions, several families from West Bengal’s Birbhum district, who had been working in Delhi for years, were detained by police on suspicion of being Bangladeshi nationals and later pushed across the border. The high court had earlier observed that the deportation process was carried out “in hot haste" and violated procedures laid down by the Union Home Ministry regarding verification and deportation protocols. “The detainees have their relations residing in the State of West Bengal…the kind of overenthusiasm in deporting the detainees, as visible herein, is susceptible to misunderstanding and disturbs the judicial climate in the country," the order had stated.
