The Bombay High Court has granted bail to a young man accused under the POCSO Act and IPC provisions, nearly four years after his arrest in December 2022. The case was registered in Mumbai when the minor girl, aged thirteen, met the eighteen-year-old boy on Instagram, eventually travelling from Goregaon to Pune to stay at his Wakad home.
Highlighting the legal arguments, Advocate Hare Krishna Mishra notes that the High Court, under Justice Shyam C. Chandak's bench, observed the situation was prima facie a 'love relationship' and that the girl herself had referred to the accused as her 'Instagram boyfriend' during a medical examination. The court considered the accused's long custody, young age, and social background in its decision.
