Twisha, a 33-year-old actor from Noida was found dead on May 12 at the Bhopal residence of her husband, lawyer Samarth Singh, located in the Katara Hills area. Following the incident, police registered a case against Samarth Singh and his mother, retired judge Giribala Singh, under charges of dowry harassment and abetment of suicide. A Special Investigation Team (SIT) has also been constituted to probe the allegations further. Husband of Twisha Sharma, Samarth Singh, who has allegedly been absconding since her death 10 days ago, approached the Delhi High Court seeking permission to surrender before the trial court in connection with the case. Twisha Sharma, who died on May 12 at her matrimonial home in Bhopal nearly five months after her marriage to advocate Samarth Singh, was found dead under suspicious circumstances.
Her family has alleged dowry harassment and foul play. Appearing for Singh, senior advocate Mrigendra Singh submitted before the court that his client was willing to surrender and sought protection to enable him to do so before the trial court. Solicitor General Tushar Mehta, however, opposed the plea, contending that the accused could surrender directly before the investigating officer and did not require the court’s intervention for the same. During the hearing before Justice Avanindra Kumar Singh, Solicitor General Tushar Mehta opposed any relief to Samarth Singh, arguing that the accused had “no right" to intervene in proceedings related to the second post-mortem. Mehta told the court that Singh could surrender directly before the investigating officer if he wished to do so and did not require court protection. Senior advocate Singh said the family wanted Twisha’s body handed over to them to perform the last rites, describing her as their daughter-in-law. He also argued that the plea for a second post-mortem reflected a lack of faith in the initial examination and in the doctors who conducted it.
Hearing the matter, Justice Avanindra Kumar Singh considered multiple pleas, including Samarth Singh’s anticipatory bail application, a petition seeking cancellation of anticipatory bail granted to his mother Giribala Singh, and the plea for a second post-mortem. The bench discussed possible alternatives, including transferring the body to AIIMS Delhi or calling an expert medical team from Delhi to Bhopal for the examination. The Advocate General assured the court that the State government would provide all logistical support required for the procedure. The court observed that ordering a second post-mortem should not be viewed as casting doubt on the earlier examination or the doctors involved, but said it could serve the interests of all parties concerned. The High Court ultimately directed that the second post-mortem be conducted in Bhopal by an expert team from AIIMS Delhi and ordered that the entire procedure be videographed. The videography report will also form part of the post-mortem record. The court also issued notice to Giribala Singh on the plea seeking cancellation of her anticipatory bail and posted the matter for further hearing on Monday.
