A US federal court has struck down the $100,000 fee imposed by Donald Trump on new H-1B visas, delivering a massive victory for Indian students and tech workers. US District Judge Leo Sorokin in Boston ruled that the steep fee constituted an unlawful tax unauthorised by Congress. The ruling stems from a lawsuit filed by 20 Democratic state attorneys general against the policy announced in September.
Previously, employers paid between $2,000 and $5,000 for the visas. The reversal offers significant financial relief to major Indian IT firms, including Infosys, TCS, Wipro, and HCL, by lowering the cost of hiring foreign engineers. Indians remain the largest beneficiaries of the H-1B programme, securing the majority of the 65,000 visas issued annually. The decision secures the American dream for thousands of Indian families, directly impacting over 730,000 current H-1B visa holders and their 550,000 dependants living in the United States.
The Trump administration must now evaluate whether to appeal the federal court's decision.
