The Bombay High Court has granted relief to Cadila Pharmaceuticals Limited while pulling up the Maharashtra Food and Drug Administration for its trigger-happy approach. The court observed that powers must be exercised judiciously rather than displayed, noting that shooting first and asking questions later is a rule of the Wild West that does not apply in law. The hearing followed a petition filed by Cadila against a stop-sale order issued by the drug regulator over alleged irregularities.
Fearing that patients would be deprived of necessary medicines, the court intervened, after which the regulator assured that mandated procedures, including issuing show-cause notices and seeking written responses, would be followed.
