Ajit Doval Marks Seven Years Of Article 370 Abrogation With Kashmir Visit Security Advisor Ajit Doval spent the seventh anniversary of the abrogation of Article 370 interacting with residents in south Kashmirâs Shopian district, where he walked through local markets, spoke to people and shared a meal with them. The visit came on the day marking seven years since Parliament revoked the special status of the erstwhile state of Jammu and Kashmir. He interacted with people and also enjoyed a meal with them, with the visit focusing on public outreach on the anniversary of the constitutional change.
The anniversary marks the events of August 5 and 6, 2019, when Parliament revoked the provisions of Article 370, ending the special constitutional status enjoyed by the erstwhile state of Jammu and Kashmir. Article 370 was a temporary provision of the Constitution that granted special autonomous status to Jammu and Kashmir. It made the state the only one in India with its own Constitution. On August 5, 2019, the President issued Constitutional Order C.O. 272, extending all provisions of the Indian Constitution to Jammu and Kashmir and changing the interpretation of Article 370. Parliament also passed a resolution recommending that Article 370 should cease to operate and approved the Jammu and Kashmir Reorganisation Bill. The following day, on August 6, Constitutional Order C.O. 273 made all provisions of Article 370 inoperative except Clause 1, which states that the Constitution applies to Jammu and Kashmir.
At the time, Jammu and Kashmir was under Presidentâs Rule. Parliament exercised the powers of the state legislature, a step that later became part of the legal challenge before the Supreme Court. What changed after the move? Following the revocation of Article 370, Jammu and Kashmir lost its separate Constitution and its special legal arrangements. Central laws and welfare schemes became applicable to the region without the earlier consent requirements. Article 35A also became inoperative, ending its provisions relating to permanent residents. The former state was reorganised into two Union Territories â Jammu and Kashmir, and Ladakh. Jammu and Kashmir also lost its statehood, with legislative powers coming under the Union administration. The Union government has maintained that the decision opened the region to investment, creating opportunities for development, employment and improved socio-economic infrastructure. Supreme Court upheld decision On December 11, 2023, a five-judge Constitution Bench of the Supreme Court unanimously upheld the Union governmentâs decision to abrogate Article 370. The court held that Article 370 was a temporary provision meant to facilitate Jammu and Kashmirâs constitutional integration with India and ruled that the President had the authority to declare it inoperative.
