In a legal development expanding protection for women, the Supreme Court has ruled that criminal law against domestic cruelty under Section 498A extends to live-in relationships that are in the nature of marriage with an intent to marry. The court observed that marriage alone cannot remain the sole basis for extending legal protection when live-in relationships are a social reality.
The judgment clarified that protection applies only to relationships that closely resemble marriage with shared responsibilities and financial independence, excluding casual or purely romantic relationships. The burden of proving that the relationship was in the nature of marriage lies with the woman seeking protection under the law.
