The Delhi High Court on Monday refused to grant bail to former AAP MLA Naresh Balyan in a case registered under the Maharashtra Control of Organised Crime Act, or MCOCA. Balyan was arrested in the MCOCA case on December 4, 2024, on the same day that a trial court had granted him bail in an alleged extortion case. He had sought bail from the high court while claiming there was "no shred of evidence" against him and that the case was "completely frivolous." The case relates to an alleged syndicate run by gangster Kapil Sangwan, also known as Nandu. The chargesheet alleges that Balyan and others were part of an organised criminal syndicate headed by Sangwan, who has been described as an absconding gangster. Balyan's arrest came hours after the BJP released an audio clip in which the former AAP legislator was purportedly heard telling gangster Nandu to threaten a Delhi builder and extort ransom from him and others.
The BJP claimed that in the clip, Balyan addressed the gangster as a brother and discussed threats and intimidation against the builder. It also alleged that the two spoke about escalating threats, demanding ransom and distributing the money collected. Earlier, on January 15, 2025, a trial court had also denied bail to Balyan in the case. During the earlier bail proceedings, the prosecutor had referred to 16 FIRs registered against alleged members of the syndicate in different parts of Delhi, and claimed that the group had created havoc in society and amassed large illegal wealth.
With the high court now dismissing Balyan's plea, he remains without bail in the MCOCA case linked to the alleged syndicate headed by Sangwan. Ends
