Bangladesh’s law minister, however, has indicated that she is likely to be arrested as soon as she enters the country. The legal outcome may appear predictable because Hasina has already been convicted. Politically, however, her return could deepen Bangladesh’s divisions, revive the Awami League and place the government under pressure from both her supporters and those demanding accountability for the 2024 crackdown. Will Hasina Be Allowed To Surrender? Bangladesh Law Minister M Asaduzzaman said Hasina has the right to return as a citizen, but made it clear that the authorities would enforce the law once she enters Bangladeshi territory. “Despite being a death penalty convict, being a Bangladeshi citizen, if she intends to surrender showing respect to the law by returning home, perhaps she will be arrested before she could do so," he told reporters. “We will exercise the authority that the law has given us," he added. The minister’s remarks suggest that Hasina may be taken into custody before she can formally present herself before a court.
Her return could also face practical complications because her passport was revoked by the interim government that succeeded her. Asked how she would travel, Asaduzzaman said: “It is her problem, not mine." “Whenever she will enter into our territory, I will enforce the authority that the law has reposed upon me," he said. Why Does Hasina Face Immediate Arrest? Hasina fled to India in August 2024 after her government was toppled following violent student-led protests. Since then, Bangladesh’s political landscape has changed dramatically. The interim administration led by Muhammad Yunus eventually gave way to a new elected government, the Bangladesh Nationalist Party (BNP), while Hasina’s Awami League has remained under severe political and legal pressure. In November 2025, Bangladesh’s International Crimes Tribunal sentenced her to death in absentia after convicting her of crimes against humanity over the crackdown on the protests. Hasina has dismissed the charges as “politically motivated". The tribunal’s proceedings have also faced international criticism. Amnesty International and Human Rights Watch described them as “flawed", while the UN human rights office raised questions about their fairness, The Indian Express reported. Bangladesh has sought Hasina’s extradition from India. New Delhi has acknowledged the request and said it remains under legal consideration. Why Does Hasina Want To Return? Hasina has framed her proposed return as both a legal and political act. In an opinion piece for The Indian Express in June, she wrote: “My absence is not silence. Even though I am away, I am with the people of Bangladesh." She also said: “I will return to the struggle to establish the rights of the people of Bangladesh.
