In an exclusive interaction, Mahesh Jethmalani, Senior Advocate of the Supreme Court, shared his insights on new legal amendments designed to fast-track investigation and trial timelines. Referring to the Nirbhaya case, Jethmalani pointed out that while trials can be completed swiftly, appellate processes historically cause delays, which the new provisions aim to fix.
Addressing concerns over deterrence, Jethmalani admitted skepticism about relying solely on heavier sentences and speedy trials, stating, "Deterrence by way of, uh, fast-track punishment, right, and higher sentencing is, uh, is only one aspect of the entire deterrent policy." He emphasized the need for broader preventive measures and attitudinal changes. Jethmalani also defended provisions allowing property attachment as well as the creation of a central Special Task Force (STF) for investigating cross-border crimes.
