According to Live Law and Bar and Bench, the student body has filed a Public Interest Litigation (PIL) through NSUI president Vinod Jhakhar, seeking an independent inquiry into the digital evaluation mechanism and remedial measures for affected students. The plea comes days after NSUI staged a protest outside the CBSE headquarters in Delhi over the same issue. On May 30, the organisation had alleged that several students received marks that did not reflect their actual performance in examinations and demanded greater transparency in the assessment process. As per Live Law, the PIL alleges “large-scale irregularities and deficiencies" in the newly introduced OSM system, which was implemented as a digital method for scanning and evaluating answer sheets.
The petition claims that after the declaration of results, students, parents and teachers across the country raised concerns over blurred scans, missing pages, incomplete uploads, mismatch of answer sheets and unexpectedly low marks. The petition further argues that the grievance redressal system available to students is inadequate and fails to provide meaningful manual verification or independent rechecking in disputed cases. According to the plea, students were left with only limited digital remedies despite serious concerns regarding evaluation accuracy. The NSUI has told the court that the issue affects lakhs of students who appeared for the CBSE Class 12 examinations under the OSM system. The plea argues that the alleged flaws in evaluation could have long-term consequences because Class 12 marks are critical for university admissions, scholarships and professional courses. DEMANDS FOR RECHECKING, OVERSIGHT Bar and Bench reported that the petition seeks directions for compensatory marks to students whose answer scripts were allegedly missing, blurred or incorrectly evaluated. The petition further requests the court to direct CBSE to allow manual rechecking and physical verification of answer sheets in disputed cases. It also seeks the reopening of the verification and re-evaluation portal for an additional month so that affected students can pursue remedies. According to the reports, the NSUI has additionally sought direct oversight by the Union government and the formulation of safeguards and guidelines for future digital evaluation systems.
The plea cites the large number of applications filed by students seeking scanned copies of answer sheets after the results were declared. Referring to CBSE’s own public communications acknowledging technical glitches on the portal, the petition notes that approximately 1,27,146 applications concerning 3,87,399 scanned answer sheets were submitted within a short period. “This figure reflects an extraordinary level of concern and lack of confidence amongst students regarding the process. When such a large number of students seek scanned copies immediately after result declaration, the matter cannot be treated as a routine post-result formality," the plea states, according to Bar and Bench. NSUI SAYS STUDENTS FACED “INJUSTICE" During the May 30 protest, NSUI activists led by Vinod Jhakhar demonstrated outside CBSE’s headquarters in east Delhi’s Patparganj, raising slogans against the evaluation mechanism and alleging irregularities in the marking process. Addressing the gathering, Jakhar had said, “Thousands of students across the country are suffering because of a careless and insensitive evaluation system. The OSM process has created confusion, injustice and distrust among students." The protesters had demanded discontinuation of the current OSM system, introduction of a transparent and student-friendly re-evaluation process and safeguards to protect students’ academic interests and mental well-being. Jakhar had also warned of intensified protests if students’ concerns were not addressed by the board.
According to Bar and Bench, lawyers appearing for NSUI said they were attempting to get the matter listed before the Delhi High Court this week. The High Court is presently functioning partially because of summer vacations, with benches sitting on alternate days. The petition has reportedly been filed through advocates Rishav Ranjan and Ajay Chhikara. Live Law additionally reported that advocates Omar Hoda, Eesha Bakshi and Shubham Mishra are also part of the legal team representing the petitioners.
