The Supreme Court of India has directed states not to take coercive action against student protesters associated with the Cockroach Janata Party-led (CJP) demonstrations at Jantar Mantar. The top court ordered the release of detained students with no prior criminal records and mandated the release of any detained minors under 18 years of age. However, the court explicitly excluded individuals with criminal antecedents from this protection, allowing investigations into FIRs to proceed while directing police to preserve CCTV and body cam footage and protect private student data.
CJP has rejected the court's exception for those with criminal backgrounds, reiterating its demand for the complete withdrawal of all FIRs against all protesters. The party maintains that any student retaliation occurred solely due to police lathi charges and teargas. Meanwhile, concerns surrounding police investigation methods, including the unauthorized use of facial recognition technology and biometric data, remain central to the ongoing legal proceedings.
