During the hearing on the quantum of sentence, the prosecution sought the death penalty for Tahir Hussain and four other convicts.
It argued that the murder was planned and carried out with extreme brutality, making it a “rarest of rare" case deserving the maximum punishment. The defence opposed the plea, asking the court to award a lesser sentence and consider mitigating circumstances before deciding the punishment. The case is related to the death of 26-year-old IB staffer Ankit Sharma, who went missing during the North East Delhi riots in February 2020. His body was recovered from a drain in the Chand Bagh area on February 26, 2020. According to the post-mortem report, Sharma had suffered multiple stab wounds and several blunt force injuries before his death. On July 22, the Karkardooma Court convicted Tahir Hussain and 10 others for offences including murder, criminal conspiracy, rioting, unlawful assembly, kidnapping, wrongful confinement and destruction of evidence.
One accused was acquitted after the court found insufficient evidence against him. The prosecution has maintained that the attack was part of a larger conspiracy during the riots and that the convicts acted with common intention. The defence, meanwhile, has denied the prosecution’s claims and sought leniency in sentencing. With both sides having concluded their arguments, the Karkardooma Court has reserved its order and is scheduled to pronounce the sentence on July 31, determining the punishment for Tahir Hussain and the other convicts.
