Leading platform aggregators including Swiggy, Zepto, Zomato (Eternal Ltd.), Urban Company, and the Internet and Mobile Association of India (IAMAI) have moved the High Court of Karnataka challenging the constitutional validity of the State’s new gig workers welfare law — the Karnataka Platform-Based Gig Workers (Social Security and Welfare) Act, 2025.
The petition, filed in the registry of the court on June 27 and yet to be listed for hearing, also challenges legality of rules framed under the gig workers Act, the Welfare Board notification, and government orders fixing welfare fee rates. The petition has also sought the quashing of recent notices directing companies to constitute Internal Dispute Resolution Committees and pay welfare fees and file fee payment returns by July 5.
The petitioners argue that the State law is repugnant to the Centre’s Code on Social Security (COSS), 2020, which already establishes a uniform national framework for gig worker welfare. They contend that the gig workers Act imposes parallel obligations, creating dual compliance burdens and additional financial liabilities, potentially forcing aggregators to contribute twice.
The IAMAI comprises the members who fall within the definition of an “aggregator” under the COSS, 2020.
